COVID-19 and the Mandatory Code of Conduct for Commercial Tenancies

On 7 April 2020, as a result of economic pressures brought about by the COVID-19 pandemic, the Australian Government announced a mandatory code of conduct for commercial tenancies. How this will practically affect landlords and tenants in retail leases already governed by the Retail Leases Act is yet to be seen, but we remain committed to helping you work through these changes.

On 24 April 2020, the NSW Government introduced the Retail and Other Commercial Leases (COVID-19) Regulation 2020 bringing the code of conduct into law in New South Wales with respect to both retail leases and commercial leases (with changes to the Conveyancing (General) Regulation 2018).

These new regulations remain in place for 6 months.
